São Paulo – Reconciliation agreements in the area of the Regional Labor Court of the 2nd Region (TRT-2, which covers Greater São Paulo and Baixada Santista) yielded at least R $ 276 million. According to the court, this is the result of 6,617 labor settlements made during the year, “almost totally affected by the covid-19 pandemic”.
Also according to TRT-2, the Permanent Center for Consensual Methods of Dispute Resolution (Nupemec) marked more than 40 thousand hearings, of which 25 thousand were held. That is, they had the presence of both parties involved. “The number is important because, even if it does not result in an agreement, the conciliation hearing represents the construction of a dialogue and may yield agreements in the future”, says the court, highlighting the hearing in telepresence mode.
TRT highlighted some successful examples of labor reconciliations. At the East Zone Forum of the capital, for example, an agreement resulted in the payment of R $ 500 thousand. This process has been underway since the site opened in 2013. “After all the appeals, the parties opted for self-composition, even after an unsuccessful conciliation attempt that took place a year earlier.”
ABC and Barueri
In the ABC region, in November (National Conciliation Month), only one case, pending for 12 years, had a value of R $ 1.5 million. It was a process related to material and moral damages, among other rights, due to an accident at work. “The worker guaranteed, in the conciliation, a payment commitment, while the company managed to pay in installments in 25 months, adapting the debt to its cash flow.”
The court also cites a case from Barueri, in Greater São Paulo, of a 71-year-old sales manager. Agreement signed on the 4th provides for payment of debt R $ 2.75 million after recognition of employment relationship. In return, the defendant will be free from the attachment of a property.
