Labor Justice already analyzes cases related to covid-19. Prosecutor’s Office receives complaints

São Paulo – The two largest Regional Labor Courts in the country, TRT-2 and TRT-15, already have more than 200 cases related to covid-19. The first covers Greater São Paulo and Baixada Santista and the second, the entire interior of São Paulo. The State Labor Prosecutor’s Office in the state also records several complaints related to the pandemic.

In the case of the MPT in São Paulo, 11% of the complaints refer to moral harassment and abuse of management. “Among the most common complaints are not being exempt from remote work, even if there is a possibility, and the pressure to continue working even without individual and collective protective equipment”, informs the Public Ministry.

In an interval of two months, from March 24 until last Tuesday (26), the MPT-SP received 1,704 complaints involving covid-19. There are 191 cases of harassment or abuse, 15 in the health sector, nine in commerce and nine in the food sector, eight in communication companies and seven in technology and also in education. According to the Prosecutor’s Office, “employees say they are forced to work without personal protective equipment, including gel alcohol”, with the claim that this is unnecessary expense.

In addition, the MPT received complaints from workers who were under pressure to accept wage reduction “agreements”. The Public Prosecutor’s Office recalls that Provisional Measure 936, approved yesterday (28) in the Chamber, allows the contract to be suspended for a specific time and reduced working hours and wages, “as long as there is negotiation between boss and employee, even if individual”.

Vacations and telework

Other reports narrate coercion to sign vacation requests. Officials would be forced to accept to keep the job. And another situation found is that of employees who would only receive bonuses if they worked in person, even with the right to remote work. Complaints are received via the website http://www.prt2.mpt.mp.br/servicos/denuncias or through the MPT Pardal application.

In the case of TRT-2, the processes started to arrive in greater volume from April. It was just one action in February, seven in March and 77 the following month, totaling. So far, 18 have been resolved. Among the most common cases are fines such as those provided for in Article 477 of the CLT (contract termination) and FGTS.

The TRT-2 has been in remote work since March 17. In the span of two months, he delivered 73,000 sentences. Including first and second instances, there are 118 thousand decisions.

TRT-15, based in Campinas, received three cases related to covid-19 in February, 27 in March and 112 in April. In the first four months of the year, a total of 71,478 shares were received, compared to 77,912 in the same period in 2019, a decrease of 8.26%. Yesterday, the Court decided to extend the suspension of face-to-face services until June 14.
