Justice forbids Banco do Brasil to extinguish cash function – RBA

São Paulo – The 6th Labor Court in Brasília prohibited Banco do Brasil from extinguishing the cash function. The preliminary decision, issued on Thursday (18), was requested by the National Confederation of Financial Workers (Contraf-CUT). The injunction also obliges BB to pay the bonus to the clerks who receive it to work as a cashier. This is because, according to Judge Antonio Umberto de Souza Junior, “both the internal and the collective norms disallow the sudden and harmful massive contractual change promoted by Banco do Brasil”. In his decision, the magistrate also emphasizes that the elimination of the executive cash bonus will cause an “impactful reduction on his incomes”.

The judge also states that “strong banking automation and capital interests should not be the only variables to be considered when considering corporate reorganization”. According to him, in this context, “the solutions devised for efficiency gains cannot simply underestimate the human and humanitarian aspects. Much less underestimate fundamental social rights such as labor rights ”.

Banco do Brasil workers complain that the institution promoted the change without even communicating with the employees themselves. In the judge’s assessment, “the terms of the collective rule in force until August 2022 inhibit the sudden and un-negotiated extinction of the function of executive cash and the consequent pulverization of the respective bonus in precarious daily payment”.

The president of Contraf-CUT, Juvandia Moreira, said that the injunction is an important victory for workers. “The withdrawal of the bonus would significantly reduce the income of employees, who are clerks and receive the additional amount to exercise the function of cash. So, it is not fair for the bank to stop paying these amounts ”, he told the confederation portal.

The coordinator of the BB’s Corporate Commission Committee, João Fukunaga, explains that the workers tried to negotiate with the bank, but without success. “When we found out, we tried to negotiate, including through the mediation of the Public Labor Ministry (MPT). And we only seek justice after the bank refuses to comply with any of the workers’ claims. ”

João questions the “intermittent executive cashier” function proposed by Banco do Brasil, which he considers very harmful. “The employee is now taken to the cashier function at the discretion of his boss and is paid as cash only for the day he performs the function. But the problem with this is that he will never know how much his salary will actually be at the end of the month. How can you control your accounts? ”He asked.

Since January, Banco do Brasil bankers have been carrying out stoppages and protests against the cuts and takedowns promoted by the Jair Bolsonaro government. The workers criticize the restructuring announced by the bank’s management, which foresees the closing of hundreds of units and also intends to lay off 5,000 workers.
